PERSONAL DATA POLICY

 

ARSENE TAXAND hereafter (“ARSENE“) attaches great importance to the protection of personal data.

ARSENE therefore undertakes to implement appropriate measures to ensure compliance and to process personal data in accordance with the law and regulations in force.

The purpose of the present personal data policy (hereinafter the “Personal Data Policy“) is to inform you of the conditions under which ARSENE collects, processes and ensures the protection of the personal data (hereinafter the “Personal Data” or “Data“) of Internet users (hereinafter the ‘Users’) of the https://arsene-taxand.com website (hereinafter the “Site“).

You must read and agree to the Personal Data Policy before using the Site and/or the services offered therein.

The processing of Personal Data collected from the Site is carried out in compliance with the provisions of the amended law of January 6, 1978 (“Loi Informatique et Libertés”) as well as the General Data Protection Regulation no. 679/2016 (“RGPD”).

The Data controller is ARSENE.

ARSENE is the founder of the TAXAND Network, the world’s largest network dedicated to taxation.

  1. Personal Data collected and processed by ARSENE

1.1. Personal Data concerned

Any information relating to an identified or identifiable natural person constitutes personal data.

ARSENE takes care to collect and process only the data strictly necessary for the purposes as defined in article 2 of the Personal Data Policy.

Depending on your use of the Site, you may be asked to provide the following data:

  • For any request: last name, first name, email address
  • If you submit inquiries to ARSENE: all information sent via email addresses and contact forms and attachments;
  • If you subscribe to the Newsletter and/or to events organized by ARSENE: last name, first name, email address,
  • If you apply to ARSENE: surname, first name, postal address, email address, telephone number(s), position and company, professional background and training, and more broadly any information mentioned on your CV/motivation letter;
  • If you connect to the ARSENE Alumni Association (“AAA”) interface: your connection data to the AAA interface, any information exchanged on the ARSENE Alumni Association (“AAA”) discussion forum.
  • If you submit a grant application to the ARSENE Foundation: personal data mentioned in your project addressed to the ARSENE Foundation, and in particular: name of the association and its president, contact information, email address, telephone number

ARSENE also collects connection and browsing data and invites you to read the Cookies Policy, accessible at the foot of the Site.

1.2. Necessary collection to process your requests

Your Personal Data is necessary to enable ARSENE to respond to your requests.

Data whose collection is mandatory are indicated by an asterisk (“*”).  Otherwise, ARSENE will not be able to process your request. Other information is optional.

You agree to provide ARSENE with accurate and up-to-date Personal Data. In case of failure to do so, ARSENE will not be held responsible. ARSENE reserves, moreover, the right to hold you responsible for any prejudice that may result.

1.2.1. Information requests

On the Site, ARSENE provides, in particular, contact forms, in order to receive your possible requests for information and registration to events organized by ARSENE.

You can also send your requests to contact@arsene-taxand.com. Once your email has been sent, you will receive an email confirming receipt of your request at your email address. Your request will be processed as soon as possible.

1.2.2. Newsletter

On the Site, ARSENE offers you the opportunity to subscribe to its Newsletter. This Newsletter deals with ARSENE’s activities and news in ARSENE’s fields of expertise. It is sent by email only.

If necessary, you will receive a confirmation link to your email address.

You may unsubscribe at any time, via the unsubscribe link located at the end of each email or by sending your request to the following address: personal.data@arsene-taxand.com.

1.2.3. Applications

On the Site, ARSENE provides a contact form for you to send your applications. If necessary, you will receive an email confirming your application on your email address.

You can also send your application to ARSENE by email at the following address: recrutement@arsene-taxand.com. Once your application has been sent, you will receive an email confirming receipt on your email address. Your application will be processed as soon as possible.

Regarding the application file (CV and cover letter), it is mandatory to communicate the Data allowing ARSENE to verify your skills and to contact you in order to follow up your application, if necessary. Otherwise, ARSENE will not be able to process the candidate’s application.

1.2.4 ARSENE Alumni Association (“AAA”) interface

ARSENE has created the ARSENE Alumni Association (“AAA”) in order to maintain contact with and between former members of its staff.

On the Site, ARSENE provides the persons concerned with a connection form to the ARSENE Alumni Association interface. Where applicable, the storage of your connection data to the AAA interface is optional.

1.2.5. ARSENE Foundation

The ARSENE Foundation was created under the aegis of the Fondation de France. It is dedicated to supporting projects of general interest for children and young people in difficulty, particularly in the fields of education, health, professional integration and business creation.

Throughout the year, any interested association can submit a project via the grant application form on the ARSENE website.

Project applications are kept strictly confidential.

  1. Legal basis and purposes of Personal Data processing

All Personal Data processing carried out by ARSENE is based on applicable laws and regulations.

ARSENE processes your Personal Data only for the following determined, explicit and legitimate purposes, to the exclusion of any other:

  • On the basis of your free, specific, informed and unambiguous consent, your Personal Data is processed to:
  • Verify your identity,
  • Upon your request, send you its Newsletter to which you have subscribed,
  • Upon your request, register you for events organized by ARSENE,
  • Upon your request, analyze your application and have you integrate, if applicable, ARSENE’s teams,
  • Upon your request, process your requests for information,
  • Upon your request, analyze projects for the ARSENE Foundation that you have submitted, contact you about them and follow up on them, if applicable,
  • If applicable, give you access to the ARSENE Alumni Association interface,
  • Process your requests to exercise your rights, in accordance with article 4 of the Personal Data Policy,
  • Execute the contracts that bind you to ARSENE, whether you act as a service provider, partner, customer or member of the ARSENE teams,
  • Meet any legal or regulatory obligation, such as the fight against tax fraud and money laundering.
  1. How long we keep your Personal Data

ARSENE keeps your Personal Data for the time strictly necessary to fulfill the purposes for which it was collected, subject to legal and regulatory retention obligations.

The data life cycle can be divided into several distinct phases. Firstly, storage in the “active base”, then “intermediate archiving” (optional, depending on the Data concerned), followed finally by the definitive deletion of the Data.

Thus:

  • Personal Data required for the performance of contracts between you and ARSENE are kept in an “active database” for the duration of the contractual relationship, and then for a period of 5 (five) years from the end of the relationship.
  • Personal Data relating to candidates is kept in the “active database” for a period of 2 (two) years from the date of receipt of their application. At the end of the recruitment process, Data relating to unsuccessful candidates may be kept for a period of 5 (five) years, as part of an “intermediate archiving” phase before final deletion.
  • The Personal Data required to manage your Newsletter subscriptions are kept in an “active base” for the duration of your subscription, and then for a period of 1 (one) year from the date you unsubscribe, as part of an “intermediate archiving” phase before final deletion.
  • The Personal Data required to manage your requests for information are kept in an “active database” for a period of 3 (three) years from receipt of your request.
  • The Personal Data necessary for the processing of your projects sent to the ARSENE Foundation are kept in the “active database” for a period of 5 (five) years, starting from the receipt of your project, unless it has been followed up in the form of a contract with ARSENE.
  • The Personal Data necessary for the management of your access to the ARSENE Alumni Association interface is kept in the “active base” for the duration of your registration to the interface, and then for a period of 5 (five) years from the date of your deregistration.
  • The Personal Data required to manage requests to exercise your rights are kept in the “active database” for a period of 5 (five) years from receipt of your request.

At the end of the above-mentioned period, your Personal Data will be deleted.

  1. Your rights and how to exercise them

4.1. Right of access, modification, deletion, opposition and portability

You have the right to access, modify and delete your Personal Data. In this respect, you may :

  • Access all the Data collected about you by ARSENE,
  • Access the Data on which ARSENE has based a decision concerning you,
  • Obtain a copy of it (ARSENE may request the payment of expenses not exceeding the cost of reproduction),
  • Demand that your Data be, corrected, completed, updated or deleted, subject to the exceptions provided for by the applicable laws and regulations,
  • Define the fate of your Data after your death (conservation, deletion or transmission to a third party that you have previously designated),

You also have the right to oppose :

  • the re-use of your Personal Data for solicitation purposes, in particular commercial, when subscribing to services offered on the Site;
  • the processing of your Personal Data, for legitimate reasons, unless it meets a legal or regulatory obligation.

Finally, the right to portability offers you the possibility of recovering your Personal Data in a structured, open and machine-readable format. This enables you to store or transmit them easily from one information system to another, with a view to reusing them.

4.2 Exercising your rights

To exercise your rights or request information concerning your Personal Data, you may send a written request to ARSENE, accompanied by a copy of both sides of your identity card, to the following addresses:

ARSENE undertakes to provide you with the information requested under the above conditions, within a maximum of 1 (one) month from receipt of your request. This period may be extended if the request is complex or requires further study.

If the time limit for processing your request is extended, you may ask ARSENE to implement the limitation of your Personal Data. This right to limitation allows ARSENE to “freeze” the use of your Personal Data while your request is being processed.

  1. Recipients and transfer of Personal Data

ARSENE does not communicate your Personal Data to third parties, apart from its service providers or subcontractors (partners), whose access to your Personal Data is necessary to achieve one of the purposes set out in article 2 of the Personal Data Policy.

In particular, ARSENE may communicate your Personal Data to its service providers in charge of organizing events in which you participate, where applicable.

ARSENE has ensured that all its service providers and subcontractors present the appropriate guarantees in terms of data protection.

Finally, ARSENE does not transfer any Personal Data outside the European Union. As an exception to the above, your registration for the TAXAND Network events it organizes is centralized in the United Kingdom, which has adopted a level of protection substantially equivalent to the level of protection required by the RGPD.

ARSENE does not transfer your Personal Data in any way, whether for commercial purposes or for any other use.

  1. Confidentiality and security of Personal Data

The security and confidentiality of Personal Data are essential to ARSENE.

For this reason, ARSENE ensures that the members of its teams, its partners and its subcontractors who, due to their function/role, may have access to your Personal Data, are subject to a strict obligation of confidentiality.

ARSENE implements appropriate technical and organizational measures to protect Personal Data against damage, loss, misappropriation, intrusion, disclosure, alteration or destruction.

ARSENE has also ensured that all its subcontractors/partners/suppliers present the appropriate guarantees in terms of Personal Data protection.

  1. Changes to the Personal Data Policy

ARSENE reserves the right to modify the Personal Data Policy, in particular in order to take into account any changes to the law and regulations in force.

ARSENE will notify you of any changes to the Personal Data Policy by means of an information banner posted on the Site’s home page, which must be read and accepted in order to continue using the Site and Services.
